Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you", "your", "Customer") and moonBYTE Technologies LLP, a Limited Liability Partnership registered in India with its place of business in Ajmer, Rajasthan ("moonBYTE", "Zapac", "we", "us", "our"). They govern your access to and use of the Zapac website at zap.ac and the Zapac link, QR-code and analytics services (together, the "Service").

By creating an account, or by accessing or using the Service, you agree to these Terms and to our Privacy Policy and Acceptable Use Policy, which are incorporated by reference. If you are entering into these Terms on behalf of a company or other organisation, you represent that you are authorised to bind it, and "you" refers to that organisation. If you do not agree, do not use the Service.

Pre-launch notice. Zapac is currently in pre-launch. These Terms govern your use of this website today, and the full Service once it becomes available to you. Paid plans are not yet offered; the billing terms below apply once paid plans go live.

1. The Service

Zapac is a WhatsApp-first platform for creating trackable links and WhatsApp links, generating dynamic QR codes, hosting link-in-bio pages, and viewing click and scan analytics. We may add, change, suspend or remove features over time. We will use reasonable efforts to give notice of material changes that adversely affect you.

Brand domain vs. link domains. zap.ac is our brand and account domain. Your short links and bio pages are served from separate link domains (a free shared pool, paid shared domains, or a custom domain you connect) and are never served on zap.ac. This separation is a deliberate security measure described further in Section 5.

2. Eligibility and accounts

  • You must be at least 18 years old and capable of forming a binding contract to use the Service.
  • You are responsible for the accuracy of the information you provide and for keeping it up to date.
  • You are responsible for all activity under your account and for keeping your credentials secure. Notify us promptly at support@zap.ac of any unauthorised use.
  • To activate certain links on free domains we may require identity signals such as phone verification. This is part of our anti-abuse programme and is described in our Acceptable Use Policy.

3. Acceptable use

Your use of the Service must comply with our Acceptable Use Policy ("AUP") and all applicable laws. The AUP prohibits, among other things, phishing, malware, spam, deceptive or cloaked destinations, open-redirect laundering, and illegal content. We may enforce the AUP through the graduated measures described there, up to and including suspension or termination, and we may act immediately in cases of active phishing or malware or where required by law.

4. Your links, content and the "no-fetch" principle

  • You are solely responsible for the destinations you link to, the content of your bio pages, the messages you pre-fill, and your campaigns. You represent that you have the rights to use them and that they comply with these Terms and the AUP.
  • You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, display and create technical copies of your content solely to operate, secure and improve the Service.
  • We do not automatically open your destination URLs. To protect single-use and sensitive links, our automated systems assess link safety using URL patterns, heuristics and reputation lookups rather than by fetching your destinations.
  • We may disable or remove links, QR codes or pages that violate these Terms or the AUP, or where we are required to do so by law or valid legal process.

5. Shared link domains and third-party platforms

Links on Zapac's shared link domains (the free pool and paid shared domains) are served alongside other customers' links, and shared domains carry shared reputation. Third-party platforms — expressly including WhatsApp and Meta, Google Safe Browsing, mobile carriers, browsers and email providers — assess reputation at the domain level. Their treatment of a shared domain (for example spam flagging, "suspicious link" warnings, link-preview suppression, delivery degradation, or blocking) can be affected by other users' behaviour, despite our prevention systems.

  • No warranty over third-party treatment. We do not warrant how any third-party platform treats a link or domain. In particular, Meta/WhatsApp enforcement is opaque, unannounced and offers no appeal, and we do not monitor for, and will not rotate, replace or disable a shared domain in response to, third-party reputation events. This is a disclosed characteristic of the shared-domain Service, not a defect or breach.
  • Printed QR codes. A printed or distributed QR code encodes a domain. Dynamic QR lets you change the destination, never the printed domain. We are not liable for printed materials rendered unusable by shared-domain reputation events or, in blocklist cases, domain rotation.
  • Your remedy is a custom domain. Connecting a domain you own isolates you from shared-domain reputation entirely and is the recommended configuration for deliverability-sensitive and print use cases.

6. Plans, fees, taxes and billing

Zapac offers a free tier and paid plans. When paid plans are available, fees, billing cycles and plan limits will be presented to you before purchase. Paid plans are billed through our payment processors — Stripe for international payments and Razorpay for payments in India. We never store your full card details; payment is handled by the processor's secure systems.

  • Unless stated otherwise, fees are stated exclusive of taxes. You are responsible for applicable taxes; Indian sales are subject to GST and international sales are taxed as required by your jurisdiction.
  • Subscriptions renew automatically for the chosen billing period until cancelled. You can cancel at any time, as described in our Refund & Cancellation Policy.
  • If a payment fails or an account becomes past-due, we may restrict or degrade paid features while preserving your data, and restore them when payment is resolved.
  • Refunds and cancellations are governed by our Refund & Cancellation Policy.

7. Intermediary status, complaints and takedowns

Zapac acts as an intermediary and conduit for the links and content you create; we are not the publisher of, and do not endorse, your destinations. Consistent with Section 79 of the Information Technology Act, 2000 and the Intermediary Guidelines, our safe-harbour position depends on acting on valid notice.

  • If you believe a Zapac link or page is unlawful or violates the AUP, report it to abuse@zap.ac or our Grievance Officer at grievance@zap.ac. We acknowledge grievances within 24 hours and aim to resolve them within 15 days, expedited for confirmed-malicious links.
  • For copyright complaints, send a notice with the information required for a valid takedown request to legal@zap.ac; a counter-notice process is available to affected users.
  • We operate a repeat-infringer policy and will terminate accounts that repeatedly violate these Terms or the AUP.

8. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access, in whole or in part, if you breach these Terms or the AUP, if required by law or valid legal process, or to protect the Service, other users or third parties. Where practical, enforcement is graduated, reversible and appealable; for active phishing or malware, or legal compulsion, we may act immediately. On termination, your right to use the Service ends; provisions that by their nature should survive (including Sections 4–5 and 9–14) survive. Data handling on cancellation is described in our Refund & Cancellation Policy and Privacy Policy.

9. Intellectual property

The Service, including its software, design, trademarks and the Zapac name and logo, is owned by moonBYTE Technologies LLP or its licensors and is protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with them. You retain all rights in your own content. Feedback you give us may be used without restriction or obligation to you.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or how any third-party platform will treat your links or domains (see Section 5). Any service-level commitments, if offered, will be set out separately and apply only to the paid tiers they name.

11. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business, arising out of or relating to the Service or these Terms. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid us for the Service in the three (3) months immediately preceding the event giving rise to the claim, or (b) ₹5,000. These limitations apply regardless of the theory of liability and even if a remedy fails of its essential purpose.

12. Indemnification

You will defend, indemnify and hold harmless moonBYTE Technologies LLP and its partners, employees and agents from and against any third-party claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to your content, your use of the Service, or your breach of these Terms or the AUP.

13. Changes to the Service and these Terms

We may update these Terms from time to time. Each version carries an effective date and version identifier. For material changes we will provide reasonable notice and, where required, ask you to re-accept before continuing to use the Service. Your continued use after an update takes effect constitutes acceptance of the updated Terms.

14. Governing law and dispute resolution

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Subject to any non-waivable rights you have under applicable consumer law, the courts at Ajmer, Rajasthan, India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. We encourage you to contact us first so we can try to resolve any concern informally.

15. General

These Terms, together with the Privacy Policy, Acceptable Use Policy and Refund & Cancellation Policy, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Nothing in these Terms creates a partnership, agency or employment relationship between us.
